The Service
The SCIRecordBook.org Web site (the "Service") provides access to proprietary Trophy Records and other big game hunting information previously published by Safari Club International ("SCI") in their various SCI Record Books and in various publications, including the Web site located at www.safariclub.org. The Service may also include other features, information and services of interest to hunters and to those in the hunting services trade. The choice of such features, information and services is entirely up to SCIRecordBook.org. The specific features, information and services provided through the Service may change from time-to-time or be removed without notice. SCI uses reasonable efforts to update the Service in real-time as new records are submitted and added to the Service.
Your Subscription
Your subscription provides unlimited access to the Service via the Internet through your personal password. Although you can access the Service from any personal computer that has Internet access, you may not access the information from more than one computer at any given time.
You must enter an email address and password and pay the required nonrefundable subscription fee at the time you subscribe. You must be at least 18 years old to subscribe. We will use certain technologies to ensure that only one person is using each account at any given time. Sharing your account and password with others (except for Authorized Users as described below) is a violation of this agreement and is grounds for immediate termination of your subscription without notice (without a full or partial refund of your subscription fee).
Who May Use Your Subscription
If you are an individual, your subscription is for your own personal use of the Service. It may not be shared, resold, subdivided or sublicensed to anyone else (except for immediate family members permanently residing with you in your primary residence) ("Individual Authorized Users").
If you are a business entity engaged in the hunting services trade, such as an outfitter, taxidermist, gun distributor or guide, and you choose a business subscription, use of your subscription is limited to five employees. ("Business Authorized Users") Individual Authorized Users and Business Authorized Users are referred to collectively as "Authorized Users".
Except as described above, your business subscription is not transferable to, or usable by, another person, business or other entity without our consent.
We will use certain technologies to monitor your use of the Service to be certain it is in compliance with the terms of this agreement. Use of the Service in a manner inconsistent with this agreement may result in termination of your subscription. No full or partial refunds will be offered for subscriptions terminated for use of the Service not in compliance with this agreement.
Access to the Service using special computer programs (Web Robots, Web Wanderers, Crawlers, or Spiders) designed to systematically download the information from the Service is strictly prohibited. We will use certain technologies to detect the use of these programs. Their use or any other use that could harm the Service is a violation of this agreement and is grounds for immediate termination of your subscription without notice (without a full or partial refund of your subscription fee).
Term of Your Subscription
Your subscription is effective upon receipt of payment and will continue for one year. We will attempt to notify you, using the personal information you provided to us, approximately 14 days before your subscription is due to expire. Your subscription will be automatically renewed for an additional year at the then current subscription rate and your credit card charged unless you turn automatic renewal off by visiting the online Support page and changing your account information. You represent and warrant that the personal information you have provided is true and accurate and you will promptly update any change in information through the online Support page. You are responsible for keeping your personal information current.
Control of Your Personal Information
We may occasionally allow other companies to provide information to our subscribers about their hunting-related products or services. We will never provide any personal information to these companies. We will distribute their messages on their behalf, but only if you specifically agree to receive them at the time you register or subscribe. We are not responsible for information you receive from other companies or their products or services. You should rely on this information and purchase any products or services at your own risk. You agree to hold SCI and any affiliated company harmless from any liability arising from information or using the products or services of any other company. You may opt out of receiving other information at any time by following the instructions on the online Support page.
Security of Your Personal Information SCIRecordBook.org uses safeguards consistent with current industry standards to protect the security of your personal information and to honor your choices for its intended use. Your personal information is never intentionally shared outside the company without your permission, except under conditions explained above. Within the company, your personal information is stored in password-controlled servers with limited access. Your information will be stored and processed in the United States. We will not knowingly collect personal information from any one under 18 years old.
ou also have a significant role in protecting your information. No one can see or edit your personal information without knowing your ID and password, so do not share these with others. If you believe that someone has obtained access to your ID and password without authorization, please notify us immediately.
Copyrights
The information provided by SCIRecordBook.org is the copyrighted property of Safari Club International. Your use of this information is limited to your personal use under the terms of this agreement. It may not be copied, retransmitted, sold or provided to others in any form or format except as provided for in this section of the Subscription Agreement.
We grant the news media, members, guides and outfitters a limited license to use brief portions of this material provided it is not altered, distorted, the correct species, member and score information is stated, it is not used in any way that would reflect adversely on SCI or its affiliated entities, SCIRecordBook.org is given credit for the material utilized, and SCI is identified as the copyright holder.
Use of Cookies
When you sign onto our Web site it assigns a personal identification number and sends it to your computer in the form of a small text file, called a "cookie." This cookie allows us to monitor your use of our site. This is done only for the purpose of protecting us, and you, should your ID and Password become available to someone other than you. We do not track individuals' use of the site.
If you choose to not have your browser accept cookies from the SCIRecordBook.org Web site, you will not be able to sign on.
Limitation of Liability
You acknowledge and agree that, although SCIRecordBook.org uses reasonable efforts to assure the accuracy, responsiveness and availability of the Service to its subscribers, we do not guarantee or warrant that the information included in the Service is accurate or error free or that the Service will be available and uninterrupted. WE DISCLAIM ALL WARRANTIES EXPRESS OR IMPILED REGARDING THE SERVICE. You should use reasonable caution in making any purchase arrangement with the guides, outfitters or other businesses identified in the Service, including assuring that your purchase is legal in the jurisdictions in which you and the guide, outfitter or business are located. We are not responsible for and you agree to hold SCI and any affiliated entity harmless from any damage arising from services or products provided by any such guide, outfitter or business. Under no circumstance will SCIRecordBook.org, SCI or any affiliated entity be liable for any direct or indirect damages with respect to the accuracy of the information, the availability of the Service, the responsiveness of the Service or your use of information provided to you by the Service. You should use the Service and any information included in the Service at your own risk.
Compete Agreement
This is the complete agreement with respect to your use of the Service and the SCIRecordBook.org Web site. Except for changes to this agreement posted on the SCIRecordBook.org web site, nothing published or said elsewhere should be viewed as a modification of this agreement.
Changes to This Agreement SCIRecordBook.org may occasionally update the terms this agreement. When we do, we will also revise the "last updated" date of the agreement posted on this Web site. For material changes to this agreement, SCIRecordBook.org will notify you by placing a prominent notice on the Web site.
Such changes will be effective when posted by us. Your continued use of the Service after the date upon which this agreement is changed and the changes are posted will constitute your continued acceptance of this agreement. Your only alternative, should you no longer wish to be bound by this agreement, is termination of your use of the Service. No full or partial refunds will be offered in such an event.
Additional Terms
This agreement is governed by the laws of the State of Arizona without regard to conflict of laws provisions. If you reside or are located within the United States, you agree that any dispute arising from or related to this agreement will be submitted to the state or federal courts of Arizona. If you reside outside or are located outside the United States, you agree that any disputes arising from or related to this agreement will be submitted to binding arbitration in accordance with the rules of the American Arbitration Association and conducted in English in Tucson, Arizona, USA. The provisions of this agreement are deemed severable and the invalidity or unenforceability of any provision will not affect the validity or enforceability of any other provision.
By subscribing to and using this Service, you represent that you have read the terms of this Subscription Agreement and agree to be bound by them. If you are obtaining a business subscription, you represent and warrant that your are authorized to enter into this agreement on behalf of the business.
